If the goods are made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.
Yes, Cakes Designs 3NL can make changes to the goods which are necessary to comply with any applicable law or safety requirement, and they will notify you of these changes.
If Cakes Designs 3NL is unable to deliver your order on the agreed date, or if they damage your order before delivery/collection due to preventable circumstances in their control, you can end the contract. In this case, you are entitled to a full refund of the deposit and any payments made for the undelivered order within fourteen (14) days of notification. If a direct refund is not possible, Cakes Designs 3NL reserves the right to provide an equivalent refund amount in another form, such as a Credit Note.
Once you collect the order and the exchange has
been completed with the product in appropriate condition, it is your
responsibility to store and care for the order. Cakes Designs 3NL is not liable
for any damage, accident, or mishap that may occur once the order is released
from their care and custody.
It is standard practice for heavily decorated cakes to contain a small proportion of inedible items, such as support dowels, wires in sugar flowers, or artificial flowers. It is your responsibility to ensure these are removed before consumption. Such non-edible items will be highlighted under IMPORTANT SAFETY INFORMATION on the delivery note or communicated to you upon collection or delivery.
Cakes Designs 3NL reserves the right to use images of your cake for any form of advertising, including web-based promotions, brochures, galleries, and competitions.
Cakes Designs 3NL respects your privacy and complies with the General Data Protection Regulation (GDPR). They will identify the purposes for collecting Personal Data, only Process Personal Data for the purposes identified, respect your rights in relation to your Personal Data, and implement technical and organisational measures to ensure your Personal Data is protected.
No variation of the Contract can be made after it has been entered into, unless the variation is agreed to in writing by both the customer and Cakes Designs 3NL. If you wish to make changes to your order, contact Cakes Designs 3NL, who will try their best to accommodate requested changes. However, changes may not be possible within 7 days of collection or delivery, and additional charges may apply.
You should notify Cakes Designs 3NL immediately upon collection/delivery so they have the opportunity to rectify it in time for your event. When making a bank transfer, include your Order Reference Number or Name to ensure the payment is allocated to your order.
Cakes Designs 3NL will aim to deliver the order by the quoted delivery date, but delivery times are not guaranteed. If delivery is delayed due to causes beyond their control, the delivery date will be extended, and Cakes Designs 3NL will contact you to arrange an alternative time.
If Cakes Designs 3NL cannot contact you at the agreed time and date, the product will be transported back to their premises, and it will be your responsibility to collect the order. The order will be stored for a maximum of 24 hours, after which it may be destroyed, and Cakes Designs 3NL reserves the right to seek 100% of the order value.
If a third party collects the cake on your behalf, Cakes Designs 3NL will take a photo of the order's condition at the release time, or a release form is to be signed by that person, stating the cake is received in good condition at the time of collection /delivery.
Cakes Designs 3NL reserves the right to cancel, vary, or suspend the contract if events occur which are in the nature of force majeure. In this situation, you will be provided with written notice, and any booking fees paid are non-refundable, with reference to the cancellation policy.
If Cakes Designs 3NL is unable to deliver your
order on the agreed date, or if they damage your order before
delivery/collection due to preventable circumstances in their control, you can
end the contract. In this case, you are entitled to a full refund of the
deposit and any payments made for the undelivered order within fourteen (14)
days of notification. If a direct refund is not possible, Cakes Designs 3NL
reserves the right to provide an equivalent refund amount in another form, such
as a Credit Note.
The deposit depends on the type and total cost of the order:
Online orders are paid in full at the time of order.
Bespoke orders under £100 are paid in full at the time of order, or with a £50 deposit for order reservation, with the balance paid 24 hours before the specified date or in cash on delivery.
Bespoke orders over £100 and less than £200 require 50% of the total cost (including delivery) upon acceptance of the price, with the balance payable 24 hours prior to delivery.
Bespoke and Wedding Cake Orders (£200 or above) require a 30% deposit of the total cost upon acceptance of the price, 60% two months before the date, 85% 20 days prior, and the remaining balance 24 hours before the specified date, or in cash on delivery.
If an order is placed within 30 days of the delivery or collection date, the total cost is payable at the time the order is taken.
For standard orders (non-wedding and below £200): 100% cancellation fee if cancelled 6 days or less before delivery/collection.
For wedding cakes or orders of £200 and above: Cancellation fees apply depending on how far in advance of the event the cancellation is made:
60 days or more before the event: 10% cancellation fee
30 to 59 days before the event: 50% cancellation fee
14 to 29 days before the event: 75% cancellation fee
13 days or less before the event: 100% cancellation fee
Cakes Designs 3NL may also apply cancellation charges and terminate services for failure to pay on the due dates or in cases of insolvency. They reserve the right to apply an administration fee of £10 for any cancellation for wedding cakes or orders £200 and above.

What if I have a food allergy or special dietary
requirement?
You should discuss any allergies or special dietary requirements with Cakes Designs 3NL before making payment. While they offer various dietary options, their products may not be suitable for those with food allergies or negative reactions to food products. It is the customer’s responsibility to inform Cakes Designs 3NL prior to the order confirmation of any allergy issues.
How should I store my cake?
The storage conditions depend on whether the cake is fondant covered, or buttercream covered:
Fondant-covered cakes should be stored in the cardboard box it was delivered/collected in and kept in a cool (but not cold), dark place away from direct light.
Buttercream covered cakes need not be refrigerated in winter, but in summer it is generally recommended to keep the cake in the refrigerator. If refrigerated, remove from the refrigerator at least 2 hours before serving.
What if I want to cancel my order?
You can withdraw the order before the order confirmation (Contract) has been made without incurring any liability, and all payments received will be reimbursed. To cancel after the contract has been made, you must inform Cakes Designs 3NL of your decision to cancel in writing.Via email address: customercare@cakesdesigns3nl.com
How do I place an order?
You can order goods online via the website, in person, via mobile, or through any other direct communication. The order is considered accepted once confirmed by Cakes Designs 3NL. The steps for ordering online are available on the Website. It is your responsibility to ensure you have used the ordering process correctly.
How old must I be to place an order?
You must be at least 18 years old and eligible to enter into a contract to purchase goods from the website.
How will I know if my order has been accepted?
A contract is formed only when you receive an email confirming the order (Order Confirmation). You should check the Order Confirmation is complete and accurate and inform Cakes Designs 3NL immediately of any errors, as they are not responsible for any inaccuracies in the order placed by you.
Can Cakes Designs 3NL reject my order?
Yes, Cakes Designs 3NL can reject an order for
any reason, although they will try to inform you without delay.
How long is a quotation valid for?
A quotation is valid for a maximum period of 15 days from its date, unless expressly withdrawn earlier.
Does Cakes Designs 3NL deliver?
Yes, delivery is offered for certain destinations. Delivery charges are calculated on a mileage and time basis plus an admin fee, with free delivery available for certain destinations. Alternatively, orders can be collected free of charge from the premises.
Is my deposit refundable?
The initial deposit which reserves your order is non-refundable.
What happens if I can't pay the deposit?
If you are unable to pay the deposit at the time the order is taken, you should make it known to Cakes Designs 3NL, and they will work together with you to find a suitable solution.
Are the cake images on the website exactly what
I will get?
No, the images on the website are examples, and because all products are handmade, your cake may have variations.
What if the delivered goods do not conform to
the contract?
Cakes Designs 3NL has a legal duty to supply goods in conformity with the contract. Upon delivery, the goods will be of satisfactory quality, reasonably fit for any particular purpose you made known to Cakes Designs 3NL before the contract, and conform to the contract.
Under what circumstances is Cakes Designs 3NL not liable?
Subject to certain exceptions, Cakes Designs 3NL is not liable for (i) loss which was not reasonably foreseeable to both parties when the Contract was made, or (ii) loss (e.g., loss of profit) to the Customer's business, trade, craft or profession which would not be suffered by a Consumer, because Cakes Designs 3NL believes the Customer is not buying the Goods wholly or mainly for its business, trade, craft or profession.
